 CUSTOM MADE TO ORDER - TERMS

1. SCOPE OF TERMS

 

These Terms govern all services associated with the Ekanem Orok CUSTOM MADE TO ORDER and SIZE CHART, including but not limited to:

  1. Measurement guidance

  2. Size selection assistance

  3. Made-to-measure services

  4. Bespoke tailoring (men’s and women’s)

  5. Alterations and fit adjustments

By using these services or submitting measurements, you agree to be legally bound by these Terms.

 

2. MEASUREMENT RESPONSIBILITY

 

2.1 Client (Primary Responsibility)

All measurements submitted to Ekanem Orok are provided solely at the client’s risk.

You expressly acknowledge that:

  • Measurements must be accurate, current, and taken correctly.

  • Errors in measurement submission are the sole responsibility of the client.

     

2.2 Professional Measurement Recommendation

We strongly recommend measurements be taken by a qualified professional tailor.

Ekanem Orok shall not be liable for inaccuracies arising from:

  • Self-measurement

  • Third-party measurement errors

  • Misinterpretation of our measurement guide

 

3. SIZE CHART DISCLAIMER

The Ekanem Orok size chart is provided for general guidance only.

You acknowledge that:

  • Sizes are not universal and may vary by design, fabric, and structure.

  • Selecting a size based on the chart does not guarantee a perfect fit.

  • Minor deviations (±1–2 inches) may occur due to craftsmanship and fabric behavior.

Ekanem Orok disclaims all liability for:

  • Incorrect size selection by the client

  • Fit expectations based solely on the size chart.

 

4. MADE-TO-MEASURE SERVICES

4.1 Definition

Made-to-measure garments are produced using standard patterns adjusted to the client’s submitted measurements.

4.2 Fit Expectation

You acknowledge that:

  • Made-to-measure is not equivalent to full bespoke tailoring.

  • Minor adjustments may be required upon delivery.

4.3 Liability Limitation

We are not liable for fit issues resulting from:

  • Incorrect measurements

  • Body posture or proportion changes after submission

  • Weight fluctuation

 

5. BESPOKE TAILORING SERVICES

5.1 Nature of Service

Bespoke garments are handcrafted based on client specifications and measurements.

5.2 Artistic Interpretation

You acknowledge and accept that:

  • Each garment is a handcrafted piece.

  • Slight variations in design execution, embellishment placement, and finishing may occur.

5.3 Fittings (Where Applicable)

Where fittings are not physically conducted (e.g., remote clients), the client assumes full fit risk.

 

6. ALTERATIONS POLICY

6.1 Eligibility

Alterations may be offered at our discretion.

6.2 Cost Responsibility

  • Alterations due to client measurement errors are chargeable.

  • Complimentary adjustments (if any) are limited and determined solely by Ekanem Orok.

6.3 Third-Party Alterations

We are not responsible for outcomes of alterations performed by third-party tailors.

 

7. NON-REFUNDABLE SERVICES

Due to the personalized nature of our services:

  • All made-to-measure and bespoke garments are FINAL SALE.

  • No refunds, returns, or chargebacks will be accepted once production has commenced.

This includes:

  • Measurement-based errors

  • Fit dissatisfaction

  • Design expectation differences

     

8. CLIENT ACKNOWLEDGEMENT OF RISK

By placing an order, you expressly acknowledge that:

  • You understand the inherent risks of remote tailoring.

  • Fit is influenced by multiple variables beyond our control.

  • You accept full responsibility for the accuracy of all submitted information.

 

9. PRODUCTION & DELIVERY TIMELINES

​

  • Production timelines are estimates and not legally binding deadlines.

  • Delays may occur due to:

    • Fabric sourcing

    • Craftsmanship processes

    • High order volumes

Ekanem Orok shall not be liable for any loss arising from delays.

 

10. LIMITATION OF LIABILITY

​

To the fullest extent permitted by Nigerian law:

Ekanem Orok shall not be liable for:

  • Fit dissatisfaction

  • Measurement-related errors

  • Indirect or consequential losses

Maximum liability shall not exceed the amount paid for the service in question.

 

11. CHARGEBACK & DISPUTE PROTECTION

You agree that:

  • Initiating a chargeback for a custom or made-to-measure order constitutes a breach of these Terms.

  • Ekanem Orok reserves the right to:

    • Provide these Terms as evidence in dispute resolution

    • Pursue recovery of funds and associated costs

       

12. FORCE MAJEURE

​

We are not responsible for delays or failure due to events beyond our control, including:

  • Supply chain disruptions

  • Government restrictions

  • Natural events

​

13. GOVERNING LAW

​

These Terms shall be governed by the laws of the Federal Republic of Nigeria.

All disputes shall be resolved in Nigerian courts.

 

14. AMENDMENTS

We reserve the right to modify these Terms at any time. Continued use of our services constitutes acceptance of updated Terms.
