1. SCOPE OF SERVICES

These Image Consultation Terms (“Consultation Terms”) govern all image consulting, styling, wardrobe advisory, personal branding, fashion strategy, and related professional services (“Services”) provided by Ekanem Orok Limited (“Ekanem Orok”, “we”, “us”, “our”).

 

Services may include:

• Personal image consultation

• Wardrobe audits

• Style analysis

• Personal shopping guidance

• Event styling

• Corporate image consulting

• Personal brand positioning

• Virtual styling sessions

By booking or participating in any Service, you agree to these Terms.

2. NATURE OF SERVICES

Our Services provide professional guidance and opinion based on expertise in fashion and image consulting.

Services:

• Are advisory in nature.

• Do not constitute legal, financial, medical, or psychological advice.

• Do not guarantee specific personal, social, or commercial outcomes.

Results vary depending on individual implementation and external factors.

3. BOOKING & PAYMENT

3.1 Payment Requirement

Full payment is required prior to confirmation of booking unless otherwise agreed in writing.

 

3.2 Non-Refundable Fees

Consultation fees are non-refundable once:

• Booking is confirmed; or

• Preparation work has commenced; or

• The session has taken place.

 

3.3 Rescheduling

Clients may request rescheduling at least 48 hours prior to the session.

Late cancellations or no-shows may result in forfeiture of fees.

We reserve the right to refuse repeated rescheduling requests.

4. CLIENT RESPONSIBILITIES

Clients agree to:

• Provide accurate personal information

• Attend scheduled sessions punctually

• Participate in good faith

• Follow through with recommendations at their discretion

We are not responsible for dissatisfaction arising from:

• Client refusal to implement advice

• Misinterpretation of guidance

• External third-party influences

5. WARDROBE AUDITS & PERSONAL SHOPPING

Where Services involve wardrobe review or shopping:

• We may recommend third-party retailers or products.

• We are not responsible for product quality, retailer policies, or availability.

• Purchase decisions are solely the Client’s responsibility.

We do not guarantee price stability or inventory availability.

6. CONFIDENTIALITY

We respect client privacy and will not disclose confidential personal information without consent, except:

• Where required by law

• For internal administrative purposes

• For safety or compliance reasons

Clients agree not to record sessions without written permission.

7. IMAGE RIGHTS & PROMOTIONAL USE

Unless otherwise agreed in writing:

• We may request permission to use anonymized testimonials.

• We may use before-and-after images only with written consent.

No client image will be used for marketing without explicit authorization.

8. INTELLECTUAL PROPERTY

All materials provided during consultation, including:

• Style guides

• Digital lookbooks

• Personalized recommendations

• Presentation materials

• Frameworks and methodologies

Remain the exclusive intellectual property of Ekanem Orok Limited.

Clients may not:

• Copy or distribute materials

• Repurpose frameworks for commercial use

• Train others using proprietary methods

Unauthorized reproduction constitutes infringement.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages.

• We are not responsible for third-party reactions or outcomes.

• We are not liable for wardrobe purchases made by the Client.

• Total liability shall not exceed the consultation fee paid.

Services are provided “as is” without guarantee of specific results.

10. PERSONAL BRAND & PUBLIC IMAGE DISCLAIMERS

Advice regarding public image, branding, or reputation:

• Is strategic guidance only.

• Does not guarantee social media growth, employment, or business success.

• Does not constitute PR, legal, or crisis management advice unless separately contracted.

 

11. HEALTH & PERSONAL SENSITIVITY DISCLAIMER

Image consultation may involve discussion of:

• Body shape

• Color analysis

• Styling adjustments

Clients acknowledge that:

• Advice is provided respectfully and professionally.

• We are not liable for emotional reactions arising from subjective interpretation.

 

12. VIRTUAL CONSULTATIONS

For virtual sessions:

• Clients are responsible for internet connectivity and device compatibility.

• We are not liable for disruptions due to client technical issues.

• Sessions may not be recorded without written consent.

 

13. FORCE MAJEURE

We are not liable for delays or cancellations caused by:

• Illness

• Technical failures

• Government restrictions

• Natural disasters

• Transportation disruptions

Sessions may be rescheduled where possible.

14. TERMINATION

We reserve the right to terminate Services without refund if a Client:

• Engages in abusive behavior

• Violates intellectual property rights

• Acts unlawfully

• Defames the company

Termination does not waive our legal rights.

15. INDEMNIFICATION

Clients agree to indemnify and hold harmless Ekanem Orok Limited against:

• Claims arising from client misuse of recommendations

• Third-party claims related to client decisions

• Defamation or misrepresentation by the Client

 

16. DISPUTE RESOLUTION

All disputes shall be resolved through binding arbitration in Lagos, Nigeria in accordance with the Arbitration and Mediation Act 2023.

Class or representative actions are waived.

We reserve the right to pursue injunctive relief in court for intellectual property violations.

 

17. GOVERNING LAW

These Terms are governed by the laws of the Federal Republic of Nigeria.

18. POLICY MODIFICATIONS

We reserve the right to update these Terms at any time.

Continued booking or use of Services constitutes acceptance of revised Terms.
